Terms & Conditions
These Terms and Conditions (“Agreement”) govern the services provided by Nishad Adnan Photography ( Proprietor: MD Adnan Khairullah). By booking our services, you agree to the following terms:
1. Booking & Payment
1.1 A signed agreement and a non-refundable retainer of 50% are required to secure your booking.
1.2 The remaining balance must be paid in full before the event/session date unless otherwise agreed in writing.
1.3 Payments may be made via Cash, Zelle, or Card.
2. Cancellations & Rescheduling
2.1 If the Client cancels the booking, the retainer is non-refundable.
2.2 Cancellations made within 72 hours of the event/session will result in 50% of the remaining balance being due.
2.3 Rescheduling requests must be made at least 5 days before the original date and are subject to availability.
3. Photographer’s Obligations
3.1 The Photographer will use professional skill and judgment to capture the best possible images under the circumstances.
3.2 While every effort is made to capture requested moments, the Photographer cannot guarantee the inclusion of every individual, object, or background.
3.3 In the unlikely event of illness, emergency, or unforeseen circumstance, the Photographer reserves the right to appoint a suitable replacement or issue a refund.
4. Client Responsibilities
4.1 The Client must ensure cooperation of guests, family members, and participants during the session.
4.2 The Client is responsible for obtaining any necessary permissions or permits for the chosen location(s).
4.3 The Photographer will not be held responsible for compromised coverage due to lateness, restrictions, or interference beyond their control.
5. Image Delivery & Editing
5.1 Standard delivery time for edited images is two weeks after the session/event.
5.2 The Photographer will provide professionally edited images at their artistic discretion. Raw/unedited files are not included unless otherwise agreed in writing.
5.3 Final images will be delivered via online gallery, Cloud drive, USB or prints as agreed in the contract.
6. Copyright & Usage
6.1 The Photographer retains full copyright to all images created.
6.2 The Client is granted a personal, non-commercial license to use, share, and print the images.
6.3 Commercial use (including advertising, resale, or publication) requires prior written permission and may incur additional licensing fees.
6.4 The Photographer may use selected images for portfolio, website, social media, and promotional purposes unless the Client submits a written request otherwise.
7. Liability
7.1 The Photographer is not liable for unforeseen circumstances including but not limited to weather, venue restrictions, accidents, or technical issues beyond reasonable control.
7.2 In the event of complete photographic failure, liability is limited to a full refund of amounts paid.
7.3 The Photographer is not responsible for damage to products once they have been delivered.
8. Privacy & Data Protection
8.1 Client information will be kept confidential and used only for the purposes of delivering agreed services.
8.2 Images may be stored securely in digital format for archival purposes.
